We respect intellectual property rights and expect our users to do the same. Our terms prohibit converting or distributing content you do not own or have permission to use, and we act on credible reports.
Although we operate from Pakistan rather than the United States, we follow a notice-and-takedown process modelled on the US Digital Millennium Copyright Act, because it is a clear and fair procedure that rights holders already understand.
Before you send a notice
Two things worth checking, because they resolve most reports faster than we can:
- Is the app on an app store? If the infringing app is live on Google Play, report it to Google as well — Google can remove the listing, which we cannot. Our removal stops it being built and distributed through us; it does not delete an app already published elsewhere.
- Is it actually infringing? Someone building an app of their own site that resembles yours is not infringement. Copying your content, your code, your images or your branding is.
Sending a takedown notice
Email support@saiftech.com with "DMCA notice" in the subject. To be actionable, your notice must include all of the following:
- A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
- Identification of the copyrighted work you say has been infringed — a link to your website, or a description of the work.
- Identification of the infringing material, specific enough for us to find it: the app name, package name, download URL or Play Store listing.
- Your contact details — name, address, telephone number and email.
- A statement that you have a good faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the owner or authorised to act on the owner's behalf.
Incomplete notices slow everything down. If yours is missing something we will tell you what, but we cannot act until it is complete.
What we do when we receive one
1. Review
We check that the notice is complete and that the material is something we host or build. We aim to complete this within two business days.
2. Remove
If the notice is valid we remove or disable the material: the project, its stored content and any build artifacts we are hosting for it.
3. Notify
We tell the user what was removed and why, and forward a copy of the notice, including your contact details. Anyone filing a notice should expect to be identified to the person they are reporting — that is how the process works.
Counter-notice
If your material was removed and you believe that was a mistake — you own the content, you have a licence, or the use is otherwise lawful — send a counter-notice to the same address containing:
- Your signature.
- Identification of the removed material and where it was.
- A statement, under penalty of perjury, that you have a good faith belief it was removed as a result of mistake or misidentification.
- Your name, address, telephone number and email.
- A statement consenting to the jurisdiction of a court where you are located, and that you will accept service of process from the party who filed the original notice.
We forward valid counter-notices to the original complainant. If they do not tell us within 10 to 14 business days that they have filed a court action, we may restore the material.
False notices
Deliberately misrepresenting that material is infringing carries real consequences, including liability for damages and legal costs, and we do refer repeated bad-faith reporters to the party they targeted. Do not use this process to attack a competitor.
Repeat infringers
Accounts that are the subject of repeated valid notices are terminated. We treat two upheld notices as a warning and a third as grounds for permanent closure, and we may act sooner for deliberate, large-scale infringement.
Trademarks and impersonation
The same address handles trademark complaints — an app using your brand name, logo or store listing to appear to be yours. Include your registration details if the mark is registered, and identify the app precisely. Impersonation is also a breach of our terms in its own right, whether or not a registered mark is involved.
